Terms of Service.

1. Agreement and scope

These Terms of Service form an agreement between you and Kelixo, the independent operator of KuKirin Dash, concerning kukirin.app, the KuKirin Dash web application, the Android application distributed through Google Play, its licensing services, and related features. By purchasing, activating, accessing, or using KuKirin Dash, you agree to these terms and the linked Privacy Policy and Refund Policy.

If you do not agree, do not purchase, activate, or use KuKirin Dash. If you use the app on behalf of an organisation, you confirm that you have authority to bind it to these terms. Google Play's applicable terms also govern your use of Google Play and its billing services.

2. Eligibility

You must be legally capable of entering a contract and legally permitted to operate the relevant scooter. If you are under the age of legal majority where you live, a parent or legal guardian must approve the purchase and use where permitted by law.

You are responsible for ensuring that your scooter, device, browser, Bluetooth setup, and intended use comply with local laws, traffic rules, insurance requirements, and age or licensing restrictions.

3. Access and license

After a completed and verified purchase, KuKirin Dash supplies or links a license key and grants a limited, personal, non-exclusive, non-transferable, revocable right to use the app for lawful personal purposes. “Lifetime access” means access for the supported lifetime of the KuKirin Dash product or service, subject to these terms, technical availability, and applicable law. It does not guarantee that every feature, platform, operating-system version, device, scooter model, or third-party service will remain available forever.

• The license key must be kept private and may be subject to browser or installation locking.
• A verified Google Play purchase may be restored and linked to its existing KuKirin Dash buyer record and license instead of creating a duplicate account, buyer number, or key.
• Reasonable reset and recovery support may be available when you change device, browser, or account email.
• The license may not be sold, rented, published, shared publicly, or used by unrelated people.
• Future updates are included while KuKirin Dash continues to provide them, but specific future features or model-specific controls are not guaranteed until released.

Your purchase evidence, main account email where provided, and license key are important proof of access. Keep them secure. Licence/account synchronization does not upload or synchronize your detailed ride history, which remains local unless a feature clearly says otherwise.

4. Purchases, price, and payment

Prices are shown before checkout. Any optional project-support amount selected through the website is added to the displayed product price. Applicable tax, currency conversion, app-store pricing, and payment-provider terms may apply as shown at checkout. Web payments are processed by the provider identified in the checkout flow. Android in-app purchases are processed by Google Play. KuKirin Dash does not receive full card, bank, wallet, or Google account credentials.

For a web purchase, you must provide an accurate delivery email. For a Google Play purchase, the Android app sends the purchase token and product details to the KuKirin Dash server, which verifies the purchase with Google Play before licence fulfilment. The Google Play account email is not necessarily supplied to KuKirin Dash; you may add or change your main account email in Settings for recovery and communication.

A purchase is complete only after the relevant provider confirms a paid, valid transaction and server-side fulfilment assigns or reconnects the shared KuKirin Dash licence record. Restoring or reverifying the same Google Play order must not create an additional entitlement. Duplicate, reversed, cancelled, refunded, charged-back, fraudulent, unpaid, incorrectly priced, unverified, or otherwise invalid transactions do not create or preserve a right to a license.

Refunds and withdrawal rights are governed by the Refund Policy, the applicable payment provider or Google Play process, and mandatory applicable law.

5. Compatibility and supported profiles

Only scooter models and controller revisions explicitly described as supported should be treated as compatible. Model names, production years, firmware, replacement controllers, regional versions, browser changes, and Bluetooth bridges can affect compatibility. A visually similar scooter or controller is not necessarily compatible.

KuKirin Dash verifies known controller profiles before enabling supported commands wherever the profile provides a reliable identity mechanism. You must review current compatibility information and setup requirements before purchase. Planned or researched models are not guaranteed support.

6. Riding and controller safety

KuKirin Dash is a rider companion, not a safety system, vehicle controller certification, navigation authority, diagnostic instrument, or substitute for inspection and maintenance. Telemetry, range, grade, weather, G-force, launch timing, and event detection are estimates and may be delayed, incomplete, or inaccurate.

• Do not interact with the app while doing so would distract you from riding.
• Test controls while stationary and in a safe environment before relying on them.
• Keep the scooter maintained and use a physical lock where theft protection matters.
• Do not rely on electronic lock, mode lock, Smart Range, weather, GPS, or fault information as your only safety measure.
• Never use app features to violate speed, road, lighting, insurance, or vehicle laws.

7. Acceptable use

You may use KuKirin Dash only lawfully and in accordance with these terms. You must not:

• share, resell, sublicense, publish, or fraudulently obtain license access;
• circumvent authentication, rate limits, controller verification, safety checks, or technical restrictions;
• probe, attack, overload, interfere with, scrape, or gain unauthorised access to the service, its APIs, storage, or other users' records;
• use the service to send unknown, unsafe, unlawful, or unauthorised controller commands;
• upload malicious, deceptive, infringing, or unlawful material; or
• reverse engineer or extract protected service components except to the limited extent such restriction is prohibited by applicable law.

8. Local data, privacy, and third parties

Detailed ride history is designed to remain on your device unless a feature clearly states otherwise. Browser data can be lost if you clear site storage, remove the app, reset the browser, or lose the device. You are responsible for making exports or backups that matter to you.

Use of KuKirin Dash is also subject to the Privacy Policy. Payment, maps, weather, email, licensing, hosting, browser extensions, and other third-party services operate under their own terms and may change or become unavailable. KuKirin Dash is not responsible for third-party services beyond responsibilities that applicable law imposes on us.

9. Changes, testing features, and availability

The Android app is publicly available through Google Play. Individual features may still be labelled beta, experimental, or model-specific. Those features may contain defects, change, or be withdrawn. We may update the app, supported models, interface, security, documentation, providers, and technical requirements to improve safety, reliability, legal compliance, or compatibility.

We do not promise uninterrupted or error-free availability. Maintenance, Google Play or other provider outages, browser or operating-system changes, network conditions, Bluetooth limitations, security incidents, or events beyond reasonable control may interrupt access, purchase verification, or restoration. We will use reasonable care to restore service and preserve an already verified entitlement where practical.

10. Intellectual property and brand notice

KuKirin Dash, its original software, interface, documentation, branding, and content are owned by Kelixo or used under permission and are protected by applicable intellectual-property laws. These terms grant access to use the product, not ownership of it.

KuKirin Dash is independently developed and is not affiliated with, endorsed by, or sponsored by KuKirin. KuKirin is a trademark of its respective owner. References to scooter brands and models describe compatibility only.

11. Service standard and warranties

We will provide KuKirin Dash with reasonable care and skill and will honour any statutory guarantee or conformity obligation that applies to your purchase. Except for rights and warranties that cannot lawfully be excluded, the app is supplied on an “as available” basis. We do not guarantee uninterrupted access, universal compatibility, exact telemetry, a particular range, or suitability for every scooter, device, location, or purpose.

No statement in marketing, community discussion, roadmap material, or support communication guarantees an unreleased feature unless expressly incorporated into your purchase contract.

12. Limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.

To the extent permitted by law, KuKirin Dash is not liable for indirect or consequential loss, lost profits, lost opportunities, lost or corrupted local trip data, third-party outages, unauthorised scooter use, or loss caused by unsafe riding, unlawful use, unsupported hardware, ignored warnings, poor maintenance, or modifications outside the app's verified functionality.

Where liability may lawfully be limited, our aggregate liability arising from the paid service will not exceed the amount you paid for KuKirin Dash. This cap does not apply where applicable law requires a greater remedy.

13. Suspension and termination

You may stop using KuKirin Dash at any time. We may suspend or terminate access where reasonably necessary to address fraud, chargebacks, license sharing, security threats, unlawful use, material breach of these terms, or risk to users, scooters, or the service. Where appropriate, we may give notice and an opportunity to resolve the issue.

Termination does not erase payment, security, support, or legal records that must reasonably or lawfully be retained. Provisions intended by their nature to continue after termination remain effective.

14. Governing law and disputes

These terms are governed by the laws of Malta, without prejudice to mandatory consumer protections that apply in your country of residence. Nothing here deprives an eligible consumer of the protection of mandatory local law or the right to bring proceedings in a court available under applicable consumer law.

15. Changes to these terms

We may update these terms for new features, safety, security, legal, provider, or operational changes. The latest version will be posted at kukirin.app/terms with a revised date. Material changes affecting existing paid access will be communicated where reasonably practical. Changes do not remove rights already accrued under mandatory law.

Dash Underground: Ambassador terms

Participation is optional for existing paid riders legally capable of entering this agreement. There is no application, follower requirement, posting obligation, sales target, employment relationship, or authority to represent KuKirin Dash. You do not need to purchase additional licences to participate. No earnings are guaranteed.

The initial Ambassador reward is EUR 0.15 per valid referred purchase, not a percentage of the price or optional project support. Insider unlocks after 100 confirmed referred riders and pays EUR 0.20 for future valid purchases. Inner Circle pays EUR 0.25 for future valid purchases; its qualification threshold is not published and access is not guaranteed. Tier changes do not recalculate historical rewards. A reward is confirmed only after server-verified payment and licence fulfilment. The last valid rider referral link opened in the buyer's browser before checkout applies, for up to 30 days in that browser; it is fixed when the order is created. Ordinary purchase visits create no referral attribution. Buyers can remove referral cookies through their browser's site-data settings. Referrals cannot be added retrospectively to existing orders.

Self-referrals, fraudulent payments, impersonation, spam, misleading claims, and payment/refund farming are not eligible. Refunds (including partial refunds) and disputes reverse the associated reward. A reversal after transfer may create a negative balance and pause further transfers while support reviews the record. We will keep a reason and audit trail for adjustments, and you can challenge an error through support.

Clearly disclose the reward when sharing your link, close to your recommendation. For example: “I receive a small reward if you buy through this link.” Share genuine experiences, respect platform rules and advertising laws, and never imply that you are KuKirin or an official representative. There are no rewards for recruiting other Ambassadors or their downstream referrals.

The first completed transfer request has a minimum available balance of EUR 2.00. After that first transfer is marked paid, later requests have a minimum of EUR 5.00. Requesting a transfer reserves the full available balance; it does not automatically send money. You must choose a payout method and provide accurate destination details. Crypto transfers require the correct asset, network, and wallet; bank transfers may require the account holder, IBAN, and BIC; card payouts are arranged only through a supported payout service and must never include a full card number, expiry date, or security code. We may reasonably verify ownership and investigate suspected abuse before payment. Incorrect destination details may delay or prevent payment. Rejected requests release their reservation; any separate reversal or adjustment remains recorded. You are responsible for tax obligations that apply to your rewards; mandatory withholding and reporting obligations remain applicable.

Your old referral codes remain reserved to your membership when you change your ID. One ID change is allowed every 7 days. Future tier changes apply to future eligible purchases and do not silently rewrite confirmed historical rewards. We may pause participation to address abuse or legal requirements, with review available through support. Ending the programme does not erase valid accrued rewards; contact support to arrange settlement, including where the normal minimum would otherwise prevent a final transfer. Mandatory legal rights are unaffected.
