Terms of Service.

1. Agreement and scope

These Terms of Service form an agreement between you and Kelixo, the independent operator of KuKirin Dash, concerning kukirin.app, the KuKirin Dash web application, its licensing services, and related features. By purchasing, activating, accessing, or using KuKirin Dash, you agree to these terms and the linked Privacy Policy and Refund Policy.

If you do not agree, do not purchase, activate, or use KuKirin Dash. If you use the app on behalf of an organisation, you confirm that you have authority to bind it to these terms.

2. Eligibility

You must be legally capable of entering a contract and legally permitted to operate the relevant scooter. If you are under the age of legal majority where you live, a parent or legal guardian must approve the purchase and use where permitted by law.

You are responsible for ensuring that your scooter, device, browser, Bluetooth setup, and intended use comply with local laws, traffic rules, insurance requirements, and age or licensing restrictions.

3. Access and license

After a completed purchase, KuKirin Dash supplies a license key and a limited, personal, non-exclusive, non-transferable, revocable right to use the app for lawful personal purposes. “Lifetime access” means access for the supported lifetime of the KuKirin Dash product or service, subject to these terms, technical availability, and applicable law. It does not guarantee that every feature, platform, or third-party service will remain available forever.

• The license key must be kept private and may be subject to browser or installation locking.
• Reasonable reset support may be available when you change device or browser.
• The license may not be sold, rented, published, shared publicly, or used by unrelated people.
• Future updates are included while KuKirin Dash continues to provide them, but specific future features or scooter profiles are not guaranteed until released.

The purchase email and license key are important proof of access. Keep both secure.

4. Purchases, price, and payment

Prices are shown before checkout. Any optional project-support amount selected by you is added to the displayed product price. Applicable tax, currency conversion, or payment-provider terms may apply as shown at checkout. Payments are processed by the payment provider identified in the checkout flow; KuKirin Dash does not receive full card or wallet credentials.

You must provide an accurate delivery email. A purchase is complete only after the payment provider confirms payment and server-side fulfilment assigns a license. Duplicate, reversed, fraudulent, unpaid, incorrectly priced, or otherwise invalid transactions do not create a right to a license.

Refunds and withdrawal rights are governed by the Refund Policy and mandatory applicable law.

5. Compatibility and supported profiles

Only scooter models and controller revisions explicitly described as supported should be treated as compatible. Model names, production years, firmware, replacement controllers, regional versions, browser changes, and Bluetooth bridges can affect compatibility. A visually similar scooter or controller is not necessarily compatible.

KuKirin Dash verifies known controller profiles before enabling supported commands wherever the profile provides a reliable identity mechanism. You must review current compatibility information and setup requirements before purchase. Planned or researched models are not guaranteed support.

6. Riding and controller safety

KuKirin Dash is a rider companion, not a safety system, vehicle controller certification, navigation authority, diagnostic instrument, or substitute for inspection and maintenance. Telemetry, range, grade, weather, G-force, launch timing, and event detection are estimates and may be delayed, incomplete, or inaccurate.

• Do not interact with the app while doing so would distract you from riding.
• Test controls while stationary and in a safe environment before relying on them.
• Keep the scooter maintained and use a physical lock where theft protection matters.
• Do not rely on electronic lock, mode lock, Smart Range, weather, GPS, or fault information as your only safety measure.
• Never use app features to violate speed, road, lighting, insurance, or vehicle laws.

7. Acceptable use

You may use KuKirin Dash only lawfully and in accordance with these terms. You must not:

• share, resell, sublicense, publish, or fraudulently obtain license access;
• circumvent authentication, rate limits, controller verification, safety checks, or technical restrictions;
• probe, attack, overload, interfere with, scrape, or gain unauthorised access to the service, its APIs, storage, or other users' records;
• use the service to send unknown, unsafe, unlawful, or unauthorised controller commands;
• upload malicious, deceptive, infringing, or unlawful material; or
• reverse engineer or extract protected service components except to the limited extent such restriction is prohibited by applicable law.

8. Local data, privacy, and third parties

Detailed ride history is designed to remain on your device unless a feature clearly states otherwise. Browser data can be lost if you clear site storage, remove the app, reset the browser, or lose the device. You are responsible for making exports or backups that matter to you.

Use of KuKirin Dash is also subject to the Privacy Policy. Payment, maps, weather, email, licensing, hosting, browser extensions, and other third-party services operate under their own terms and may change or become unavailable. KuKirin Dash is not responsible for third-party services beyond responsibilities that applicable law imposes on us.

9. Early Access, changes, and availability

KuKirin Dash may include Early Access, beta, experimental, or model-specific features. Such features may contain defects, change, or be withdrawn. We may update the app, supported profiles, interface, security, documentation, providers, and technical requirements to improve safety, reliability, legal compliance, or compatibility.

We do not promise uninterrupted or error-free availability. Maintenance, provider outages, browser changes, network conditions, Bluetooth limitations, security incidents, or events beyond reasonable control may interrupt access. We will use reasonable care to restore service where practical.

10. Intellectual property and brand notice

KuKirin Dash, its original software, interface, documentation, branding, and content are owned by Kelixo or used under permission and are protected by applicable intellectual-property laws. These terms grant access to use the product, not ownership of it.

KuKirin Dash is independently developed and is not affiliated with, endorsed by, or sponsored by KuKirin. KuKirin is a trademark of its respective owner. References to scooter brands and models describe compatibility only.

11. Service standard and warranties

We will provide KuKirin Dash with reasonable care and skill and will honour any statutory guarantee or conformity obligation that applies to your purchase. Except for rights and warranties that cannot lawfully be excluded, the app is supplied on an “as available” basis. We do not guarantee uninterrupted access, universal compatibility, exact telemetry, a particular range, or suitability for every scooter, device, location, or purpose.

No statement in marketing, community discussion, roadmap material, or support communication guarantees an unreleased feature unless expressly incorporated into your purchase contract.

12. Limitation of liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.

To the extent permitted by law, KuKirin Dash is not liable for indirect or consequential loss, lost profits, lost opportunities, lost or corrupted local trip data, third-party outages, unauthorised scooter use, or loss caused by unsafe riding, unlawful use, unsupported hardware, ignored warnings, poor maintenance, or modifications outside the app's verified functionality.

Where liability may lawfully be limited, our aggregate liability arising from the paid service will not exceed the amount you paid for KuKirin Dash. This cap does not apply where applicable law requires a greater remedy.

13. Suspension and termination

You may stop using KuKirin Dash at any time. We may suspend or terminate access where reasonably necessary to address fraud, chargebacks, license sharing, security threats, unlawful use, material breach of these terms, or risk to users, scooters, or the service. Where appropriate, we may give notice and an opportunity to resolve the issue.

Termination does not erase payment, security, support, or legal records that must reasonably or lawfully be retained. Provisions intended by their nature to continue after termination remain effective.

14. Governing law and disputes

These terms are governed by the laws of Malta, without prejudice to mandatory consumer protections that apply in your country of residence. Nothing here deprives an eligible consumer of the protection of mandatory local law or the right to bring proceedings in a court available under applicable consumer law.

15. Changes to these terms

We may update these terms for new features, safety, security, legal, provider, or operational changes. The latest version will be posted at kukirin.app/terms with a revised date. Material changes affecting existing paid access will be communicated where reasonably practical. Changes do not remove rights already accrued under mandatory law.
